TikTok’s Privacy Concerns of the Government

TikTok, A popular app among Millenials, Gen Z and even Baby Boomers. This app was developed in September of 2016 by ByteDance, first known as Douyin and would later on rebrand to TikTok for better international appeal. This app is used to create and share content with the purpose of entertainment, marketing, promotion and so much more. TikTok spread like wildfire in the United States, people love to spend their time scrolling on TikTok shorts and making videos to pass the time or even get the fame that they dream of attaining.

With over a Billion of monthly users, 80 Million of these monthly users are based in the United States. Due to the massive success of the app, there have been growing concerns about the security of the privacy of the users, especially users that are in the government. Sensitive and private data of the users should only be accessible by the users but the threat of TikTok collecting private data is what concerns the government. This raised the action of a criminal investigation in TikTok’s parent company, ByteDance, for improper access to the personal information of users in the United States.

Sensitive data and information such as their personal info, location, browsing history, biometric identifiers, and private files that are stored in the device are prone . Lawmakers renewed their scrutiny of TikTok for its ties to China through its parent company, ByteDance, after a report that suggested US user data had been repeatedly accessed by China-based employees. TikTok has disputed the report. As a countermeasure, TikTok Rule states that the prohibition “applies to devices regardless of whether the device is owned by the Government, the contractor, or the contractor’s employees (e.g., employee-owned devices that are used as part of an employer bring your own device (BYOD) program)(FAR 52.204-27(b))).

On December 29,2022, Consolidated Appropriations Act, 2023, The Congress passed the “No Tiktok on Government Devices Act” (Pub. L No. 117-328, 136 Stat. 4459, 5258). The law requires the government to “develop standards and guidelines for executive agencies requiring the removal of any covered application” — specifically defined here as the “social networking service TikTok or any successor application or service developed” by ByteDance Limited, a Chinese internet technology company headquartered in Beijing, or an entity owned by ByteDance Limited — “from information technology”. This Idea was already in the works and introduced to the senate in 2020.

As stated by Senator Josh Hawley, TikTok is a uniquely intrusive application. The company openly admits that it tracks users’ locations, it tracks users’ keystroke patterns, it tracks the filenames on users’ devices. TikTok essentially claims the right to peer straight through our phones into our lives.

The requirements mandated by China’s National Intelligence Law allow for the potential that Chinese government officials could use TikTok to violate the civil rights and privacy of users in the United States, or otherwise gather data that may have national security implications.

FAR 52.204-27(b)
The TikTok Rule states that the prohibition “applies to devices regardless of whether the device is owned by the Government, the contractor, or the contractor’s employees (e.g., employee-owned devices that are used as part of an employer bring your own device (BYOD) program).” While there is an exception for a “personally-owned cell phone that is not used in the performance of the contract,” there is no definition of what the phrase “not used in the performance of the contract” means.

This FAR Clause will applies to:

Any solicitation issued on or after June 2, 2023;
Any contract award that occurs on or after June 2, 2023, even if the solicitation predated the rulemaking;
Existing IDIQ contracts, to be amended by July 3, 2023, to apply to future orders; and
Any modifications/option awards for existing contracts or task or delivery orders that
extend the period of performance.

The TikTok Rule widely applies to all contracts and covers IT equipment that is held by the government, contractors, and employees. Unless and until a final rule provides a more precise definition, the primary exception, which pertains to personally owned cell phones that are not used in the performance of a contract, is likely to be a source of confusion, particularly with regard to a contractor's obligations for employees who indirectly work on an irregular basis in support of a federal government contract, such as personnel, legal, or administrative staff.

"Ladies in Tech" Anthology: Empowering Women in the Tech Industry The tech industry has long been dominated by men, but a new anthology titled "Ladies in Tech" is helping to change that narrative. The anthology was Started and envisioned by Kenyatta Powers-Rucker, who noticed a lack of representation of women in the tech industry. Being in the tech industry comes with challenges and hardships, but being a woman in tech can be more difficult, especially in how women are treated in the industry. Gender bias, stereotyping, lack of representation, and unequal pay are some of the struggles women have to face in being a lady in tech.

Diversity plays a big role in the tech industry. Teams with a diverse composition outperform teams that don't prioritize diversity and inclusion in terms of performance, hiring, member engagement, and employee retention. Despite this, there are still a lot fewer women than males working in the tech industry.

A wide range of frequently connected variables are to blame for the underrepresentation of women in the computer sector, and this situation continues to have an impact on salaries, opportunities, and workplace safety. But, companies that prioritize fairness and inclusion are making progress when it comes to advancing and keeping women in their professions.

Having that said, there are women who mustered up the courage to take on the unjust treatment of women and made their own name in the industry. Some of them are here to share some insight and experiences they had been a lady in tech and for us to see the struggles they had run into from their own perspective. Let us introduce the former and the present CEO of the Southern Maryland Minority Chamber of Commerce (SMMCOC), Doris J. Cammack Spencer and Pamela Minor as they share their experience in the tech industry.

On the 9th episode of the 4th season of “Lunchin with Lisa”, Doris and Pamela were asked about their experiences and wisdom about certain troubles and instances that make it difficult for women to survive and build their careers in the tech industry. Lisa served some questions that are mostly experienced by women to shed some light on their perspectives about the matter.

After their introductions, Lisa moved to ask Doris “What do you think is the reason that young ladies or women hesitate to get in this field and why don’t we have more women in this area?”. Doris answered the question with “Women aren’t originally pursuing careers that they weren’t given the opportunity to”. Gender bias is a great factor in why women won’t pursue careers in the tech industry. Even if they are capable of the job, they are mostly shut out of the opportunity because of the stereotypical mindset that women aren’t capable. She also shared her wisdom to inspire women who want to pursue a career in the tech industry and said “Do what you know you can do and don’t let anyone hold you behind”. Doris also quoted “Technology is interesting in terms of how you get in and stay in if you will, it really depends on what you want to do. Women have all kinds of opportunities now that they didn’t have”.

Moving on, Lisa followed up with a similar question to Pamela as she asked Doris. Lisa asked “Why do you think women aren’t moving into this area? Pamela answered,” Part of it I believe is the world we’re in will show media where we in it’s not sexy, so they don’t recognize what’s here for them”. The tech industry as we know it may look unappealing to some women because some may take it as a man’s field and less feminine. Some women tend to go with their passion for careers that have a feminine touch so they don’t really see the opportunity in the tech industry and what’s in it for them. Pamela also said that terminologies are a factor in how it makes women feel like they belong to the field, but because they pursued the tech field, they are now successful women in tech

Spotlight on Women in Tech: Insights from the 'Ladies in Tech' Anthology

The end of season three for Lunchin with Lisa show featured not only a group but the group of successful women who were featured in “Ladies in Tech”, the anthology. The podcast started with the season ending introduction and the projects that our host Lisa Dove Washington are having which are “Imperfectly Fierce & Focused” where she co-authored, a collaboration with Dr. Gail Crowder on a new TV show “Dr. Gail on Love, Sex & Marriage” where she is one of the production team and her upcoming event, the “Power of Shut Up Symposium” on May 13th. It was then followed by introduction of Kenyatta Powers-Rucker, the woman who started the “Ladies in Tech” the anthology.

Kenyatta was the one who gave intro for the ladies that attended to be the guest for the interview, who was attended by some of the authors, Doris J. Cammack Spencer, Martina Kuzenski, Tamara McLemore, Ashley Esposito, Pamela Minor and Kenyatta Powers-Rucker herself. In the world of tech in where it was dominated by men, the Anthology is made to feature powerful women who made mark in the world of technology that has not being given their rightful recognition. As the “Ladies in tech” are having their book tour, let them provide more information on what people will expect when they read the books.

"I have gotten every member of my family into technology, because I knew that's where they could grow, that way they would continue to learn" A mentor to a lot of people in helping them grow more into tech department, teaching them the right way and paving the way for generations to come, Doris shared her start as one of the pioneer of the Ladies being in tech, she wants to make sure that as she grows in the industry she also make sure that she will be able to teach the younger generations that will follow her footsteps, training them as a mentor and helping them into success. A woman who laid down the foundation for the other women who wants to enter the industry.

Tamara was then asked by Lisa on why the number of women going to technology are low, and she did a great job in answering with “It is difficult because we don’t see ourselves, you have to be strong, you have to have thick skin and must understand what you have to bring to the table and there are other skills that one must have to be able to stay into technology.“ As a woman who didn’t know anything that tech career are a hit and she only got into the industry because of their aunt that was in the industry. She is now serving for over two decades of in-depth experience in IT project management with businesses.

Awareness in knowing that there are a lot of career opportunities in tech and that everyone can have a better career path. Ashley Esposito started being in tech with Kenyatta and what she answered to Lisa on why there are lower number of women in tech is that most are not aware of it when she said "Lack of awareness on how many different careers exist within the umbrella of tech.” "Even if people that are going to school for business or project management, like knowing that tech is a place for them to reroute". Followed by Lisa who agreed with her take that once you are in tech, then there are really a lot of several path to take when it comes to growing your career.

Martina Kuzenski is one of the youngest of the co authors of “Ladies in Tech” that started her tech career through being in movies. A young lady who wanted to spread awareness about doing tech career is okay and not being intimidated even it the career is mostly employed by men. Last guest that they asked is Pamela Minor, who shared her experience on how she entered the tech industry. As a Masscomm graduate who never had idea that it existed and due to recession that most people didn’t have job, she became a reliever until she was able to land a job in the Environmental Earth Science Firm. She alongside with Doris worked together before developing super computers, until she became the first MIS Director for the dot com and that is where her career in the tech industry became a success.

Lisa is also not new to tech industry since even she knows a lot about the technology in which she mentioned that most of the time people would think that women are not involved since they are not always being seen but in reality they also have contributions when it comes to developing technology. But then what is really Kenyatta’s vision into why she started the book? What she really want is to show that there are also women who can share their experiences and contributions when it comes to tech, but that doesn’t mean that men are not welcome to write for the “Ladies in tech” since she also wants to welcome men who would want to be an author for the book to also share their experiences so that the readers will have some comparison on what are the differences and similarities with their experiences.

“What is that one thing that keeps in the technology world?”, Lisa gave her final question during the interview in where all of the guests answered with almost same reasons on why. The reason why they stayed in the tech world is because it plates with their strength, and they are a learner since tech constantly changes it means that the learning will never stop to keep up with the pace of changes. Also, they wanted to be a representation for other black women to be in the industry because most of the time no one is there to represent them and talking about representing, they also want to keep fighting about for the neurodivergent, to show them that it is possible for everyone to be successful in the world of tech because someone made it and went. from not being only a leader but also land a successful job

Pamela then ended the question with, "Most computer people have some king od musical background, the creativeness is part of who we are". The representation of the artistry of the people behind the tech industry that they have to be creative in order to create a masterpiece when developing technology. This is what Kenyatta envisioned on how the book to be successful, that all the authors will work together as one in lifting the women and showing the world that success of tech industry is more about men and women working together. Darlene Breck is an accomplished business executive and community leader with a proven track record of helping small businesses thrive in Southern Maryland. As the founder and president of the Southern Maryland Business Center in White Plains, Maryland, Darlene has provided professional office suites and conference rooms to 36 local companies since 2003. She aims to provide a fully-equipped, class-A facility that helps entrepreneurs avoid the high overhead costs of leasing a start-up office space.

In addition to her work at the Southern Maryland Business Center, Darlene has extensive experience in marketing, contract negotiations, employee hiring and supervision, budgeting, payroll, operational planning, record keeping, and financial reporting. She has also held leadership positions in various organizations, including past president of the Charles County Chamber of Commerce and past chair of the University of Maryland Charles Regional Medical Center Foundation board.

Southern Maryland Business Center has been in operation for almost 14 years. They relocated to their new home, a Class A facility at the White Plain Corporate Center office park, six years ago from their original location, a former real estate office in Waldorf. According to Breck, "We discovered that clients demand the amenities that come with a Class A building, such as security, elevators, and lobbies. With that adjustment, the company saw an increase in tenants from 26 to 36 and was awarded a contract to host the Transportation Security Administration's badge processing facility.

Darlene Breck was the former President of the Charles County Chamber of Commerce and the former Chair of the Board for the University of Maryland Charles Regional Medical Center. She has also served on the Maryland Commission for Women and the newly elected Chief Judge of the Orphans Court for Charles County. She strongly believes that being involved is the best thing you can do for your community

Women's History Month is a time to celebrate the contributions and achievements of women throughout history and in contemporary society. It is an opportunity to recognize and honor women's often overlooked and undervalued contributions to all aspects of society, including science, politics, art, literature, and culture.

It is a way of acknowledging the women who have made significant contributions to their fields and communities, even in the face of systemic gender discrimination and bias. Let’s talk about Lucinia Mundy, a dedicated business and community work woman. She is knowledgeable in developing policies, procedures, and processes for using agencies and small businesses and has worked on implementing business certification and public relations programs. Lucinia Mundy is an experienced Small and Minority Business Development Specialist with over 20 years of experience, having worked in both the public and private sectors. She holds a Master of Science in State and Local Government from the University of Maryland University College and volunteers to improve the local and global economy.

For a period of 17 years, beginning in 1987 and ending in 2004, Mundy worked as a Community Affairs Analyst for the Board of Governors of the Federal Reserve System. In this role, she focused on a range of important areas, including Community Housing and economic development, customer protection laws, micro-enterprise, regulatory bank oversight, and computer information systems management, among other responsibilities. Through her work, she demonstrated a strong commitment to serving the community and supporting small businesses.

Lucinia is a tireless community servant who has dedicated her career to making a positive impact. Starting in 1990, she spent two decades working as a Community and Business Leader, involved in a range of projects focused on fundraising for political and nonprofit organizations, commercial real estate and small business development, event planning and execution, micro-enterprise business and incubation development, business marketing and outreach, social and network marketing, and program coordination and management, among other areas. Through her work, she has helped countless individuals and organizations, and remains committed to making a difference in her community.

Ms. Mundy has had experience working at Prince George's Community College, where she played a crucial role in creating their initial Hospitality and Tourism Institute. By August 2008, she had been appointed as the coordinator of the Hospitality and Tourism program. She was responsible for overseeing a variety of tasks, including organizing and managing the college's Outreach Program, which featured over 100 computer technology, digital photography, and videography courses that were available to the general public or offered on a contractual basis to various businesses, government agencies, and professional organizations.

She is also a Small and Minority Business Development Specialist at the Charles County Economic Development Department. Before joining the Department in 2016, she spent over three years as the Purchasing Programs Outreach Administrator in the Purchasing Division of the Charles County Government's Department of Fiscal and Administrative Services. In that position, she helped implement the Small Local Business Enterprise program and created policies and procedures for using small businesses and agencies. Ms. Mundy also managed the Minority Business Enterprise program for the County.

Overall, Lucinia Mundy has extensive experience promoting and supporting small and minority businesses and has played an essential role in implementing programs and policies to help these businesses thrive.

When they set a good impression, it will make our stay with them more possible.

The human resource team, or the HR team, is constantly at the forefront of these businesses or organizations when we apply for a job or are currently affiliated with one. They create the perception of what the organization represents or must do. This only indicates that the human resource (HR) staff is essential to businesses of all sizes and sectors.

What role does the HR department play in the business, then? The HR team is initially in charge of finding, recruiting, and employing the finest personnel for the company. They also oversee onboarding, training, and development initiatives for staff members to guarantee they have the qualifications necessary to be successful in their positions. HR leads salaries, bonuses, and health insurance and oversees employee benefits and pay. They also handle employee retirement plans, manage payroll, and verify that the firm complies with all relevant laws and regulations.

Karen has made it her mission as a National Financial Educator to empower women and families by providing them with the knowledge and tools they need to take control of their finances. Karen has assisted numerous women and families across the country in achieving financial independence and security via her work as a Certified Financial Education Teacher and Certified Business Leader.

Karen C Baker is a single mother of two girls, an entrepreneur, a public speaker, a talk show presenter, a financial broker, an educator, a cancer survivor, and so much more. She has committed her life to making a difference in the world by inspiring others, caring for people around her, and bringing light into the world. “Live! Love! Reset! Karen's debut novel, "God's Plan: The Ideal Person to Get Cancer," was published in 2021.

For 19 years, Karen owned a business management consulting firm, and insurance was a big component of the services she offered to corporations and governments. When she lost her government clients as a result of the 9/11 attacks, she focused solely on the insurance brokerage side of the business. She had to terminate that part of the firm and lay off 19 staff who had begun with her as consultants. It was a difficult day for her, but she had to keep going.

With her experiences on hardships she faced, she used her knowledge to pursue helping others get through rough patches in life. This led to a change to several peoples' lives and created opportunities for them to grow as an individual. Karen’s teachings and advice has been a life changer amongst many people who trusted her wits and wisdom. Her advice to aspiring entrepreneurs is “Stay the course, no matter what. Through all the ups and downs, it takes time to have your dreams come true.”

She has altered the lives of many people who were previously battling with financial troubles because of her experience in personal finance, credit management, and wealth creation. Karen's impact, on the other hand, extends far beyond her professional role as a financial educator. She has utilized her position to inspire and motivate women in all facets of their lives as a passionate and devoted champion for women's empowerment. She has pushed women to embrace their power, chase their aspirations, and never give up on their objectives through her motivational speeches, coaching programs, and social media presence.

What is the SMMCOC and what it has in store for you.

Generally, when we start a business, even if that is a small one, it is really hard to do a good kickstart to it. A lot of things must be taken into consideration, permits, feasibility, marketing, and all the things needed to start is a problem.

If we have enough knowledge and training to start a business, we will most likely succeed due to a lack of education and expertise in handling and starting your business. If we will fail but have a chance to get back up still, will we still be able to recover if we do not have enough capital to cover everything?

Typically, if our start to go down and we do not have enough capital to help us get things back on track, we will surely go down. This is one of the biggest problems that most cannot resolve due to the lack of education and support that someone is getting and starting a small business.

Luckily, the U.S.; Government saw some of these problems and wanted to solve this dilemma for all who wish to start their own business diversely. Hence creating the USMCC, and from there, they can help people from the country have a better fighting chance in starting their business and supporting every branch they have.

Southern Maryland is not different from them; that is why for the past years, the non-profit organization formerly known as The Southern Maryland Black Chamber of Commerce, Inc. (SMBCC changed its name to The Southern Maryland Minority Chamber of Commerce, Inc. (SMMCOC) to get distinguished as one of the Subsidiary of the USMCC.

USMCC and how it affects the economy

Business is the best way for everything to grow, from the economy of every country in the world and every individual doing business. Even if millions of people in the world have made it successful, we can also say that millions of people, unfortunately, didn’t. All over the world, we cannot deny that this is the fuel that keeps the economy alive, and that is why every nation would love to do its best to help business owners succeed. The more successful business is, the more help it can give the economy.

In the United States, the Government formed a Chamber that mainly focuses on helping everyone in the country who wants to do business. This branch is called the United States Minority Chamber of Commerce, the business Hub for Entrepreneurship, job creation, income empowerment, and poverty reduction in low-income economies through the innovation of U.S. Technology, international cooperation, and global Corporate Education.

The Chamber was founded in September of 2000 with more than 35,000 members and partners in the U.S, and Latin America, with headquarters in Miami-Washington DC and Los Angeles, Puerto Rico, and international hubs in Colombia, Ecuador, Honduras, Costa Rica, Dominican Republic, El Salvador, Guatemala, and Haiti.

Everything they do at the United States Minority Chamber of Commerce aims to promote international trade and investment as vehicles for inclusive growth and prosperity through diversity, equity, and inclusion. The Chamber is one of the country’s largest, strongest diverse, multicultural, and demographic chambers. They are advocates, catalysts, and partners and recognize that to produce high-quality research that informs innovative, practical policy recommendations. They need to ensure that their personnel represents a diversity of thought, experience, and personal background. The Chamber’s vision is that diversity within the workforce enhances the relevance and substance of their work and helps them adhere more closely to their guiding principles of quality, independence and impact.
